Why Does a Pest Control Company Fall Under a Separate Permit Regime?
Two firms were set up on the same street. Both sell pest control, both hung the same sign. One began taking customers in three weeks; the other, in its fourth month, had still not signed a first corporate contract.
The difference was neither capital nor contacts. The first firm had seen from the outset which permit regime the work falls under; the second learned it after the licence was in hand. Below we open up where that difference comes from.
Two firms, two different files
Seen from outside, pest control is a cleaning service. Seen from inside, it is the application of chemical substances, in contact with people, in enclosed rooms, carrying a risk to health.
That distinction settles the whole file. A firm proceeding as a cleaning service stays within the general commercial frame; a firm moving to chemical application enters the scope of health legislation.

What creates the distinction: the nature of the product you use
What decides is not the name of the work you do but the nature of the product you use. Products used to render pests, microbes or harmful organisms ineffective are termed biocidal products.
These are not assessed in the same category as a cleaner off a supermarket shelf. Because their mechanisms of action carry a risk to people and to the environment, both the product side and the applicator side are separately regulated.
What a biocidal product means
A biocidal product is one formulated to kill a target organism or to arrest its activity. Insecticides, the products used against rodents and a portion of disinfectants all fall within that definition.
The product itself is subject to a regime of permit and registration. In practice that means this: every product you use must be permitted as the legislation requires, and asking your supplier for the paper that proves it is your job.

Where the permit regime comes in
There are two doors here and neither stands in for the other. The first is the workplace opening and operating licence issued by the district municipality; that is the basic permission to begin trading.
The second is the permit on the health side. Businesses applying biocidal products come under the assessment of the provincial health directorate. The conditions of that permit are set by regulation and revised; for your own application, confirm them in writing directly with the provincial health directorate.
Case: the firm that took the licence and skipped the permit
The mistake of the second firm above lay exactly here. It obtained the municipal licence, hung its sign, fitted out its equipment and thought the work was done.
At the first corporate tender the picture changed. The buyer’s procurement unit asked about the permit on the health side and about the certification of the staff who would carry out the work. The firm began to build those two headings from nothing and lost four months.
Why staff certification comes up
Is the person applying the product giving it at the right dose, to the right area, by the right method? The answer bears on the health of the customer and of the applicator alike.
For that reason the training and certification of field staff becomes part of the permit process. The scope and length of that training are matters of regulation; do not make a staffing plan on information found online.

The responsible manager heading
In this branch the question arises of a responsible manager carrying the technical responsibility of the business. The aim is to see that application proceeds under the eye of someone who knows the work.
Who may hold that duty, and what qualities are looked for, is set by regulation. If you are planning to form a firm, ask about this heading at the very start; it is the hardest line to solve late.
Which authority looks at what
The table below shows which heading is settled at which door. Practice can differ from province to province.
| Heading | Authority concerned | When to ask |
|---|---|---|
| Workplace opening and operating licence | District municipality | Once the address is settled |
| Biocidal application permit | Provincial health directorate | Before viewing premises |
| Responsible manager and staff certification | Provincial health directorate | Before the first application |
| The product being permitted | The supplier and the legislation | Before any purchase |
| Chemical store and waste arrangements | Municipality and environment service | Before the store is fitted |
| Personnel file and occupational safety | Social security and the safety service | Before the first recruitment |
Do not read the table as a settled ruling. A heading arising and a heading being compulsory are separate matters; obtain written confirmation for every line.
The store and the keeping of products
Where the chemical product stands is a critical heading in this work. Products are kept in a separate compartment, locked, ventilated, and out of contact with food.
Empty packaging and left-over product are not ordinary refuse. Settle where the waste will be handed over during the set-up; every waste heading solved late produces both cost and risk.
Record discipline is the condition of contract work
A corporate client buys the record of the service as much as the service. Which area, on which date, with which product, by which member of staff: all of it is wanted in writing.
- The date, the time and the area treated
- The product used, its permit details and the method of application
- The person applying it and the person responsible for supervision
- The information given to the customer and the note on the waiting period
- The date planned for the next application
That five-line record form is built in an afternoon. It is also precisely the form that opens the door with hotels, factories and food businesses.
How to read the fee and tariff side
Charges of this kind, the licence fee and the signboard tax among them, follow whatever schedule the municipality has adopted, and the schedule turns over each January. Do not enter them in a budget as though they were fixed.
Before the file is handed in, obtain the schedule valid for that year in writing from the revenue department concerned. The capital and margin bands are set out on our business services sector page.
Three notions misread
Three things are often confused in this branch: the workplace licence, the biocidal application permit and a cleaning service contract. The first is the basic permission to begin trading, the second bears on the authority to apply chemicals, the third is a commercial document.
None of the three stands in for another. To see the general order of the authorities go to the business licence roadmap; if you will sell general cleaning too, our cleaning company article, and to compare the technical service model our plumbing and technical service article.
